Farewell environmental code
The Grand Coalition failed to agree on the largest project aimed at reforming environmental law back in the beginning of February 2009. There will not be an Environmental Code (UGB) during this parliamentary term and most likely not during the coming years either.
How will matters proceed in environmental law, in particular in environmental protection at the company level? Definitive decisions have not yet been made, however, contents already adopted in the Environmental Code are to be integrated into the existing laws.
The following applies to the environmental protection seminars of the TÜV NORD Akademie:
No major adjustments are expected in the German Federal Immission Control Act. The immission control and hazardous incident officers will retain their status, rights, and duties. Please note our further education programme under pollution control.
The waste legislation was initially not affected in any way by the first section of the UGB. The primary reason for this lies in the amendment of the European Waste Framework Directive that was first adopted in November 2008. This EU directive must be implemented into German law by December 2010, which, in turn, will lead to adjustments in the Closed Substance Cycle and Waste Management Act (KrW-/AbfG) as well as its ordinances. In our waste legislation seminar, you will find out what to expect even without the UGB.
The Federal Water Act (WHG) will be amended so that the German federal government will utilise its rights acquired through the federalism reform of 2006 to establish a nationwide water management law starting from 2010. The numerous state-specific regulations will become obsolete. For example, the 16 state ordinances for "systems for handling substances hazardous to water" will be unified into a "federal ordinance on handling substances hazardous to water".
The Federal Environment Ministry submitted the draft for a law designed to revise the water law on February 4, 2009. We will monitor the additional legislative procedure and will simultaneously integrate the relevant changes into the respective course documentation.
